Divorce Decree Translation

If you’ve been previously married and divorced, your divorce decree will come up in several important processes in Portugal. Whether you’re remarrying, applying for a residence permit, or updating your civil status, Portuguese authorities need to see proof that your previous marriage was legally dissolved – and they need it in Portuguese.

Certified translation for Portugal (English to Portuguese)

When you need your divorce decree accepted by Portuguese authorities, the translation must be certified by a Portuguese lawyer, as required by Portuguese law. I handle the full process: translation, certification by a Portuguese lawyer, and delivery of a document ready for submission.

Here’s when you’ll need one:

Getting married in Portugal. If you’re registering a marriage at the Conservatoria, whether it’s a new marriage or a transcription of a foreign marriage, and you’ve been previously divorced, the Conservatoria requires your divorce decree as proof that you’re legally free to marry. It must be translated and certified.

Applying for a residence permit through AIMA. Some residence permit applications require proof of marital status, and if you’re divorced, the divorce decree is part of your document package. This is particularly relevant for family reunification applications where your current family structure needs to be documented clearly.

Portuguese citizenship applications. If you’re applying for citizenship and your marital history is relevant to the application, a translated divorce decree may be required.

Updating your civil registry status. If you married in Portugal (or had a marriage transcribed to the Portuguese registry) and subsequently divorced abroad, the divorce needs to be registered in Portugal to update your civil status. The foreign divorce decree must be translated and certified for this purpose. Note that the Conservatoria cannot process foreign divorces directly. This must be done through a Portuguese court.

Child custody and family law matters. If custody arrangements from a foreign divorce need to be recognised or enforced in Portugal, the divorce decree (including any custody provisions) must be translated.

All translations are certified by a Portuguese lawyer, as required by Portuguese law. You receive a document ready to submit to AIMA, the Conservatoria, or any Portuguese authority.

UK authorised translation (Portuguese to English)

The apostille

Your divorce decree needs an apostille from the country where it was issued before the translation can be used officially in Portugal. Apostille first, then translation.

For UK decree absolutes, the apostille is obtained from the FCDO. For US divorce decrees, the process depends on the state. Some states require you to apostille through the Secretary of State’s office, others through the state department.

What you need to provide

Send me a clear scan or photograph of your complete divorce decree, including all pages. If it’s a multi-page document, make sure every page is included. If an apostille is already attached, include that in the scan too.

If you only have a decree nisi (UK) or an interlocutory decree rather than the final decree, let me know. Portuguese authorities typically require the final, absolute decree confirming the divorce is complete.

Frequently asked questions

I have a UK decree nisi but not a decree absolute. Is that enough? No. The decree nisi is the provisional decree. Portuguese authorities require the decree absolute, which confirms the divorce is final. If you only have a decree nisi, you’ll need to obtain the decree absolute from the UK court before it can be translated for use in Portugal.

My divorce decree is very long. Does the whole thing need translating? It depends on what it’s being used for. If you’re submitting it to the Conservatoria for a remarriage, they typically need the full decree. If it’s for a residence permit, they may only need the pages confirming the divorce was granted. Can a Portuguese court recognise my foreign divorce? Foreign divorces are not automatically recognised by the Conservatoria. They need to go through a recognition process in a Portuguese court. I can handle the translation of the documents needed for this process, but for legal advice on the recognition procedure, I’d recommend consulting a Portuguese family lawyer.

What’s the difference between a certified translation and a GOV.UK authorised translation? A certified translation (English to Portuguese) is certified by a Portuguese lawyer and accepted by Portuguese authorities like AIMA and the Conservatoria. A GOV.UK authorised translation (Portuguese to English) is one I produce personally as a translator listed on the GOV.UK directory – it’s officially recognised by UK authorities.
